US Supreme Court says companies can force arbitration on class-acting consumers
Before today, Californian consumers were free to ignore the arbitration clause tucked in the fine print of every AT&T service contract because state law had declared them unconscionable -- which kept the courthouse doors open to class-acting consumers. However, in a ruling that no doubt pleases AT&T and others of its ilk, the highest court in the land has stripped the states of their power to so avoid arbitration with its ruling in AT&T Mobility LLC v. Concepcion. Spotify rumored near starting early access movie service
Spotify, the web-based music service, is nearly ready to launch a movie-streaming service, according to TechCrunch. Deals have been negotiated with a number of major movie studios, said a source, with Universal likely among them. The best guess the source of this news has for a launch date for the service is this fall.

White iPhone temporarily sells out in Beijing, Hong Kong
The white iPhone 4 has already sold out in the Chinese cities of Beijing and Hong Kong, reports say. The Beijing information comes from Ticonderoga Securities analyst Brian White, who cites checks with Asian industry sources. ElegentTech claims that the phone sold out even faster in Hong Kong, going out of stock in the space of hour thanks to lineups which formed at midnight the previous day.

Android 2.3.4 gives Android phones official video chat
Google on Thursday helped Android catch up in a key area with confirmation of the rumored Android 2.3.4 update. The update gives Android phones official video chat for the first time and uses the same Google Talk solution as on Android 3.0 tablets. Video chats work over cellular as well as Wi-Fi and let users talk both to tablets as well as to Gmail and other Google Talk-ready pages.

Motorola ships 250,000 Xooms in Winter, posts $81m loss
Motorola Mobility posted results Thursday (PDF) answering questions about the early performance of the Xoom. About 250,000 of the flagship Android 3.0 tablet shipped worldwide. About 9.3 million devices shipped in total, 4.1 million (44 percent) of which were its Android smartphones.

Newspaper thinktank predicted the iPad in 1994
It's not often (well, ever) that I consider the possibility someone might be from the future, but maybe Roger Fiddler was. In 2007 the Paleofuture blog pointed to the video below, where Fiddler and his team at Knight-Ridder describe an electronic newspaper running on what might as well be an iPad except that the video was made way back in 1994.
Most futurists are off the mark, or make forecasts for technologies that are so far off in the future, you'll never know if they are right, but the Knight-Ridder team's predictions for the "electronic tablet" were just eerie. Android 2.3.4 heading to Nexus S over the air, bringing video and voice chat to Gtalk
For an update with such a modest name, this is actually quite a major step forward. Google's about to start delivering Android 2.3.4 to Nexus S devices out in the wild, and in among all the bug fixes and optimizations, users will find the addition of video and voice chat to Google Talk. You'll be able to do it anywhere you can get a web connection going, whether by virtue of WiFi, 3G, 4G, or the force, and other Gingerbread handsets are expected to get the same improvements in time. For now, however, Google's own-branded device is the only one enjoying the very freshest Gingerbread around.

TweetyPop for iPad offers 3D view of Twitter feeds
TapFactory has launched a new Twitter client for the iPad, TweetyPop. The app employs an unusual 3D view of Twitter feeds, with the most recent tweets floating in space in the foreground. Users flick posts offscreen as they read them in order to progress to older ones in the background. Alternately, arrows or a scroll bar can jump past current tweets. More traditional viewing options include List and Slideshow modes.

Skyhook chief say Android data privacy much worse than iOS
Skyhook chief Ted Morgan in a discussion Wednesday accused Google of having much worse privacy in Android than Apple does in iOS. He argued that Android was quietly collecting data much more frequently, "1,000 times a day," and was sending background pings to Google on its own instead of just explicit location requests. Microsoft announces record Q3 earnings: $16.43 billion revenue, $5.23 billion net income
Well, it looks like the record quarters from tech companies just keep on coming -- this time it's Microsoft, which just reported a $16.33 billion in revenue in its third-quarter results, a jump of 13 percent from the previous year, and well ahead of analysts' expectations. Net income clocked in at $5.23 billion, a whopping 31 percent jump from the previous year, with Microsoft citing strong sales of Office 2010, Xbox and Kinect as key driving factors. The company also revealed that it's now sold a stagerring 350 million Windows 7 licenses, and that its Entertainment & Devices Division has grown a 60 percent year-over-year -- again, largely fueled by record-setting sales of Kinect and continued strong sales of Xbox 360 consoles and Xbox Live..

Hat Apple iCloud.com für 4,5 Millionen $ gekauft?
Neusten Gerüchten zufolge soll Apple vor Kurzem die Domain iCloud.com für die Summe von 4,5 Millionen US-Dollar, also etwa 3 Millionen € gekauft haben. Bis vor kurzem wurde diese Domain von einer Online-Speicher-Firma genutzt, die nun unter CloudMe.com zu erreichen ist. Momentan leitet iCloud.com noch auf CloudMe.com weiter, aber sobald Apple diese Domain benötigt, wird sie wohl umfunktioniert. NVIDIA brings SLI support to AMD 990FX, 990X and 970 chipsets
It's not going so far as to expand support as far as AMD has with its CrossFireX multi-GPU technology, but NVIDIA has now at least taken one step in that direction. The company announced today that it's finally bringing SLI support to AMD platforms -- specifically, upcoming motherboards based on AMD's 990FX, 990X and 970 chipsets. With help from Rodale, Melcher Media and Push Pop Press, Apple board member Al Gore has released a new e-book on the App Store, Our Choice. I love contextual menus. In Mac OS X, you find them when you right-click, two-finger-click (on a trackpad) or when you hold down the Control key and click. Intel prepping 50Gbps Thunderbolt sequel for 2015
Intel circuit strategy director Jeff Demain at an event late Wednesday teased early details of the successor technology to Thunderbolt. Though unnamed, it would use silicon photonics to transfer information at 50Gbps, or five times the speed of its just-launched ancestor. Nokia: we won't enter tablets unless we can be unique
Nokia chief Stephen Elop hinted in an interview with YLE late Wednesday that the company would be more cautious about entering tablets than others. He believed the company could go either with Windows or an in-house platform like MeeGo, but the team had to choose what was right and distinctive. Chrome OS machines leaked in bug reports: Acer netbook and touch-friendly Seaboard
Plowing through bug reports is a reliable way to dig up juicy morsels of info, and thanks to that timeless tactic we've got some specs on a pair of unannounced Chrome OS devices. iPad estimated to have grabbed 74% of winter tablet share
Apple still held on to a commanding lead in tablets in the winter, Canalys said Thursday. Escalating competition from the Samsung Galaxy Tab didn't stop the iPad and iPad 2 from getting a combined 74 percent share, making up 4.69 million of the 6.4 million tablets that shipped between January and March. SAP steigert softwarebezogene Erlöse um 20 Prozent
SAP hat das Ergebnis für das erste Quartal 2011 (PDF) veröffentlicht. Three workers at Foxconn's factories in Shenzhen, China have been formally charged with leaking the design of the iPad 2, reports say. The charges were actually filed on March 23rd, following arrests made on December 26th. The suspects are accused of violating Foxconn trade secrets rather than Apple's.

Verizon says its LTE network is back 'up and running'
Well, it looks like this week's other massive outage is now officially behind us -- Verizon just issued a brief statement to let us know that its 4G LTE network is now "up and running." Details on exactly what caused the outage remain light, however, with the company only saying that "network engineers and vendors quickly identified the issue and solved it." What's more, while it says that Thunderbolt users should now have "normal service," those with LTE modems may still have some problems when switching between 3G and 4G modes, although that will apparently "continue to improve."

Remember those iPad 2 cases we saw in December of last year that hinted at the svelte design and rear-facing camera of the iPad 2? It appears these cases were the real deal and three Foxconn employees may have been the source.
According to China-based sznews.com, Foxconn has accused three employees of leaking the iPad 2 case design to accessory companies in China. These three employees were arrested on December 26, 2010 and charged with trade secret violations on March 23, 2011.

Sprint in discussing its latest results said it had seen a notable impact from the Verizon iPhone 4. Although Sprint still had its best performance in recent years, Apple's expansion provided "very strong competition" and likely took away from potential sales, Sprint chief Dan Hesse said. You gotta be kidding. I am dying to know who, exactly, at Apple is unfamiliar with Mario the plumber. An intern born in the 90s, maybe? At any rate, go grab this platformer featuring Moninio, whose brother was captured by Bowler and is being kept in a castle. Sound familiar? It's like a mirror universe, I know.
Given how much the iPod touch and iPhone have been hurting Nintendo's DS sales, we're likely going to have to wait until the Japanese game company stops making hardware altogether to see a real Mario franchise appear on iOS. Until then (and until someone at Cupertino wakes up to an irritated email), you'll have this game. Honestly I'm not wasting the 99-cents on it, as the reviews clearly point out the controls are atrocious. You can't have a decent platformer

Apple weiterhin einer der weltweit größten PC-Hersteller
Wie Canalys meldet, bleibt Apple einer der weltweit größten PC-Hersteller. Im ersten Quartal 2011 hält Apple mit rund 8,5 Millionen verkauften Macs und iPads einen Marktanteil von 9,5 Prozent und erreicht damit den vierten Platz. Auf den ersten Platz kommt HP mit rund 14,5 Millionen Computer, gefolgt von Acer (11 Millionen) und Dell (10 Millionen). Im Vergleich zum vorherigen Quartal ist Apple allerdings einen Platz nach unten gerutscht.

There's nothing I love better than to put on a nice long multi-hour playlist while I'm working, but sometimes reality intrudes. I get a call, and I need to pause the tunes.
If I'm visiting the iTunes store on my Macintosh, then the iTunes application totally loses my place in my playlist. I have to restart my shuffled playlist, and I end up hearing song after song that I've already listened to repeat in a way that ticks off my subconscious.
Help me Auntie! How do I pause my playlist to take a call and be sure that I don't lose my place?

Fujitsus Gewinne für 2010 schrumpfen um 41 Prozent
Fujitsu hat für das am 31. März 2011 beendete Fiskaljahr 2010 einen Verlust von 41 Prozent bekannt gegeben. Der Nettogewinn schrumpfte von 93 Milliarden Yen (767 Millionen Euro) auf 55 Milliarden Yen (454 Millionen Euro). Als Gründe für das schlechte Ergebnis führte das Unternehmen das Erdbeben in Japan, das auch die Fujitsu-Werke beschädigt hatte, und den hohen Yen-Kurs an. Die Schäden durch die Naturkatastrophe seien allein für einen Verlust von 11,6 Milliarden Yen (95,7 Millionen Euro) verantwortlich. Lieferverzögerungen hätten das Unternehmen weitere 13 Milliarden Yen (107 Millionen Euro) gekostet.

NPD: Verizon iPhone made Apple 3rd in US, Android decline
The launch of the Verizon iPhone 4 in the winter not only helped Apple gain status in the US but saw Android share decline for the first time in two years, the NPD Group found on Thursday. Apple was now the third-largest phone maker of any type in the US at 14 percent, slipping only behind basic phone specialists Samsung (23 percent) and LG (18 percent). The iPhone jumped nine points in smartphones to 28 percent, but Android had slipped from a record high 53 percent smartphone sales in the fall to 50 percent spread across its several manufacturers.

Apple has purchased the iCloud.com domain name for $4.5 million, according to a new report. Apple has significantly cut its orders for the CDMA iPhone 4, according to a new report. All right, here we go. Gameloft's new title is called Order and Chaos Online, and in the Gameloft style, it's pretty much an iOS remake of Blizzard's World of Warcraft. Odds are that if you understand that sentence, you probably already know whether you want to go download this or not.
But if not, I'll explain: Gameloft has a habit, as we've said, of making iOS titles that basically rip off larger console titles, and Blizzard's World of Warcraft is of course the extraordinarily successful massively multiplayer online RPG for PCs. Nokia: Wenn Tablet, dann richtig

Let's face it: Nokia hat aktuell wirklich andere Sorgen, als sich auch noch um ein Tablet zu kümmern. Vor allem: mit welchen OS sollte das denn laufen? Aber weil alle anderen Hersteller mit großer Emphase die Slates nach vorne zu bringen versuchen, denkt man auch in Finnland nach. Sagt der Chef Stephen Elop in einem Fernseh-Interview mit dem finnischen Sender YLE. Vor allem versucht er dabei, Spuren zu verwischen und Zeit zu gewinnen. Swedish online storage firm Xcerion is rumored to have sold the web address to Apple for $4.5 million and moved over to CloudMe.com on April 5. GigaOM hadn't independently confirmed the deal, but a WHOIS check Thursday morning confirmed Xcerion was for now still officially listed as the iCloud domain owner.

Die Stiftung Warentest hat einen Smartphone-Test vorgelegt. In der Mai-Ausgabe der Zeitschrift ist nachzulesen, dass das Samsung Omnia 7 und das LG P500 Optimus One den Regentest nicht überstanden. Ich lehne an der Wand des ansonsten fast leeren Zimmers, laut spielt der CD-Wechsler die neue Tiamat-CD ab und ich tauche ein in deren Klanglandschaften, schwebe davon, genieße den Moment. Während draußen das Berliner Stadtleben herumprickelt. Es war eine Zeit, in der ich noch kein Handy besaß. Der Fernseher diente vor allem dem Abspielen von Videos aus der Videothek nebenan. Meine Computerleidenschaft befand sich auf einem absteigenden Ast: Ein altersschwacher PC mit FreeBSD wurde vereinzelt gebootet, um zwischen XEmacs und dem Opera-Browser zu wechseln - ich programmierte damals metal.de und thedarkchat.de.

Motorola freezes Droid Charge launch indefinitely, blaming 'unexpected delays'
Can't say we're surprised by this, but turns out Motorola's decided to delay the launch of its Droid Charge -- originally scheduled for today -- at the very last minute. According to a Verizon internal email we obtained, the blame's on "unexpected delays" and no new date has yet been set. This makes sense, considering it wouldn't do Verizon much good to launch a new 4G Android when its LTE service is still down (for over 24 hours and still counting). Paypal beschert Ebay erneut Umsatz- und Gewinnsteigerung
Die Ebay-Tochter Paypal hat dem Mutterkonzern erneut zu einem Umsatz- und Gewinnwachstum verholfen. Der Nettogewinn des Auktionshauses kletterte im ersten Quartal um 20 Prozent auf 475,9 Millionen Dollar (319,9 Millionen Euro) oder 0,36 Dollar je Aktie. Smartphone- und Tablet-Boom beschert ARM 35 Prozent Gewinnzuwachs
ARM hat im ersten Quartal 2011 einen Gewinn vor Steuern von 50,8 Millionen britischen Pfund (57,2 Millionen Euro) erwirtschaftet. Gegenüber dem Vorjahresquartal legte der Überschuss um 35 Prozent zu. Apple's cash reserves have grown so large that they're now worth more than the market capitalizations of Nokia, RIM an Motorola Mobility put together, notes Asymco's Horace Dediu. The company's second-quarter results brought the company up to $65.8 billion in reserves, including both straight cash and marketable securities. Supreme Court flips decision allowing class actions vs. AT&T
Customers with complaints against AT&T potentially lost a significant avenue of recourse on Wednesday after a US Supreme Court ruling overturned a ruling that required AT&T allow the possibility of class-action lawsuits. A 5-4 vote denied a lower appeals court's decision that AT&T couldn't enforce a contract provision requiring arbitration in disputes for California-based cases. D-Link in the morning brought out a wireless router with a relatively low-cost way to get both faster Wi-Fi and wired speeds. The Wireless N 300 Gigabit Router has a MIMO (multiple-in, multiple-out) antenna array that can hit up to 300Mbps over 802.11n Wi-Fi as well as gigabit Ethernet jacks both for the incoming Internet traffic and four wired users. Rogers on Wednesday detailed its launch plans for its LTE-based 4G launch. Beating Telus to concrete plans, it should have paid service in Montreal, Ottawa, Toronto, and Vancouver before the end of 2011. Antitrust oversight of Microsoft to end May 12
Microsoft will be out of the eye of special antitrust terms in less than a month, District Court Judge Colleen Kollar-Kotelly said in the last hearing ever in the case. Oversight of the company's actions, including direct access to its computers and records, would no longer be mandatory after May 12. The watch had been originally limited to five years after a 2002 settlement but had been extended multiple times after technical problems and other issues that needed to be taken care of, including some running past the deadline.

Barnes & Noble in a response (PDF via Groklaw) both rejected many of the claims of Microsoft's anti-Android lawsuit but directly claimed Microsoft was violating antitrust law through its deal with Nokia. The Nook maker claimed that the Microsoft-Nokia pact for patent deals was "per se illegal" under antitrust laws. Analyst: white iPhone could increase sales by 1M or more
Analyst Brian White of Ticonderoga Securities reacted to the long-delayed arrival of the white iPhone 4 by predicting it could push sales of the popular phone even higher, AppleInsider reports. He believes that it will attract some customers that may have passed on the black model, along with new customers who simply waited for the white color to be available. US Army starts military app store for iOS, Android
WIRED today provided an preview of what may become the military's own version of an online apps store. Named Army Marketplace, the Army hopes the site will provide a source of downloadable Army-relevant software for soldiers' work computers and mobile phones. Distimo: Android Market could eclipse App Store in 5 months
Android Market is growing quickly enough that it could have a larger app count than the iOS App Store in five months, Distimo estimated in its April update. Researchers believed Google's store had swelled 16 percent in March to hit 206,143 active apps where Apple's shop, though larger, had grown just six percent to 333,214 active titles. The gap could close to 40,000 apps by the end of June and close entirely by July.

AT&T tells unofficial tethering users it will upgrade plans
AT&T has sent out a second SMS warning to subscribers it believes are illegally tethering their phones, and this one contains a more stern message. The carrier has told these users they will soon be automatically upgraded and billed for its tethering plan, which includes 4GB and raises monthly data plans by $20 to $45. Pegatron rumored cutting CDMA iPhone 4 production early

The Omni Group has released a public beta of its project management software, OmniPlan 2.0. The focus of the v2 release is collaboration, with support for project sharing within a team and sync support over MobileMe, Omni Sync Server or a WebDAV server. Tasks publish automatically on saving by a team member, and new changes can be grabbed over Bonjour at pre-determined intervals. Rumor: Apple might have bought iCloud.com
GigaOm is reporting that Sweden-based cloud storage company Xcerion has just sold its iCloud.com domain name for US$4.5 million and that the likely buyer is none other than Apple. Xcerion had previously sold a cloud-based storage services called iCloud, but they have just rebranded it CloudMe after the sale of the iCloud.com domain.
While GigaOm doesn't get into specifics, the site says their source is familiar with the company and that the buyer of the domain name is Apple. Currently the WhoIs information still lists Xcerion as the owner of iCloud.com, but that could be a purposeful move until Apple reveals its new cloud-based services.
Even though GigaOm doesn't name its source, it does fit in with other reports that Apple is gearing up to launch a

The elusive white iPhone 4 is elusive no more. It's already gone on sale internationally; this included screenshot is from Vodafone in New Zealand. The white iPhone 4 is expected to see release in several international markets over the course of the day, with release in the US likely to come within the next few hours.
The white iPhone 4 still hasn't shown up on Apple's own store site yet as of this writing, not even in countries where the handset has already been available from carriers' stores for several hours, but it should be available at the company's US brick-and-mortar stores when they open later today.

GarageBand for iPad running on an iPhone 4
YouTube user PSPfano has posted a video of GarageBand for iPad running on an iPhone 4. He accomplished this by using a hack (detailed on 9to5) which allows users to modify jailbroken iPhones and allows them to run most iPad apps on them. After applying the hack, PSPfano moved the GarageBand for iPad app with altered metadata to an iPhone 4 via OpenSSH.
The hack isn't perfect though. As PSPfano states on his YouTube page, "I got GarageBand running on my iPhone 4. Obviously, it isn't properly formatted, but for some reason the track editor worked really smooth and is fully functional." As always, with any h

MIT's genetically modified viruses boost solar-cell efficiency by herding nanotubes
The wizards of MIT have done it again. Having checked artificial leaves and Operabots off the to-do list, they've moved on to improving the efficiency of solar cells. Their technique combines a genetically modified version of the M13 virus with carbon nanotubes, which have already been shown to increase efficiency. NMA explains Locationgate in animated form
Those wild and crazy guys from Taiwan's Next Media Animation have weighed in on the Locationgate blow-up, and as usual they haven't let the facts get in their way.
The video states that the location information is sent to Apple's servers for all sorts of nefarious purposes -- but of course, it was made before Apple's announcement today. As we posted earlier, the data is used to help your phone zero in on its own location as quickly as possible, and it may represent cell towers that could be 100 miles away. Fring app brings group video calling to iPhone
Fring has updated its popular iOS IM app to allow group video calls on the iPhone. This is a first for group video calling on any iOS device as far as I know and its a much welcome feature. The group video calling allows you to video chat with up to three of your other friends over 3G, 4G, or Wi-Fi.
To take advantage of the new group video calling features, you'll need an iPhone 4 or the latest iPod touch with front-facing camera. Technically, the app will work with devices with only rear-facing cameras, but that kind of defeats the purpose of video calling if you need to have the rear camera on you and can't look at the screen and see the people you are chatting with.

Google Docs gets an Android app, we go hands-on with tiny spreadsheets (video)
Staring at spreadsheets crushed down to unreadable sizes on a 4-inch phone screen is far from pleasurable but, clearly there is a demand. In fact, we've been clamoring for a proper Google Docs app for ages, even though sometimes we're not entirely sure why. US Army to launch its own app store
Wired got an early look at an app marketplace designed by the Army for the Army. It will be populated with titles specific to Army operations and will support both desktop computers and mobile devices. The Army Marketplace will launch with 16 iPhone apps and 17 Android apps, most of which were designed as part of the Apps for Army contest. These apps will be available for a nominal fee to Army employees.
The marketplace will let soldiers submit ideas for new apps which can be discussed by fellow soldiers and developed in-house if possible. Apps that require outside help will be put out to bid and developed by a third-party contractor.
