Google urges dismissal of class-action book scanning suit
In a filing with the US district court in Manhattan, Google has urged the dismissal of a class-action lawsuit claiming the company copied thousands of authors' works without permission. Google has said that it has scanned 20 million books and has posted snippets of more than four million since agreeing with large libraries to digitize current and out-of-print works. Google claims the authors have demonstrated no economic harm from the indexing of the works, and reap the benefits of the online availability.

Chitika: Mountain Lion accounting for 3% of web traffic
Web tracking firm Chitika has a stat that's actually not all that surprising: Mountain Lion downloads accounted for a relatively huge percentage of web traffic this week. For all web traffic coming to and from Mac computers, Mountain Lions downloads specifically make up 3% of the total. And when you consider just how much bandwidth is being used, that means that Apple almost certainly sold plenty of copies of the new US$19.99 operating system.
Chitika also did the math, and believes that Apple users downloaded 2.11 million copies of Mountain Lion in just the first 48 hours after release. Obviously, that's downloads, not purchases -- it's possible that users purchased the OS without downloading it. It's also

Samsung attempts evidence spoilation claim versus Apple
Following Magistrate Judge Paul S. Grewal's grating of an Apple motion for an adverse inference jury instruction against Samsung for continued deletion of emails even when the pre-trial process began, Samsung has filed for one of its own. A previous ruling opened the door for Samsung's filing, saying in a footnote that Apple's alleged failure to issue formal litigation hold notices to its employees on some communications in August 2010 allowed Samsung to argue (at the appropriate time) that Apple is also guilty of evidence spoliation. TUAW Origin Stories: Model Release
There are a few "model release" apps on the market. These apps have boilerplate contracts which allow a model in a photo or video to virtually sign those contracts. Model Release was created by a fashion photographer to meet his needs, however, and as such I think it's one of the best of its kind out there. 3D printer cuts vinyl, mills, draws, fits comfortably inside a briefcase, is generally fab
Is there anything this tool from MIT's Ilan Moyer and collaborator Nadya Peek can't do? Probably, but that list seems likely to be shorter than the list of those it can. So far, Popfab has been shown doing a little printing during a brief video, but Moyer has promised a lot more to come, telling Core 77, "we also have toolheads working for vinyl cutting, milling and drawing," all of which promise to show up in subsequent episodes. IDC: Samsung, Apple almost half of smartphone sales
The International Data Corporation released its Worldwide Quarterly Mobile Phone Tracker report yesterday, revealing that Samsung and Apple have more than doubled their collective market share in the smartphone sector and now account for nearly half of worldwide smartphone sales. The figures demonstrate the efficacy of the two companies' divergent approaches to the smartphone sector. The report showed that other manufacturers have a long way to catch the two leaders in the sector, but some relative newcomers appear to be making headway in the low-end market.

WebHelpDesk acquired, Mac and Linux versions disappear
Web Help Desk is software that runs on Mac OS Server, among other platforms -- it's an enterprise "help tracking" package that allows small and large companies to track IT and help support across large teams and customer bases. Users access the ticketing system via their web browsers, or via their iPhones with the Web Help Desk iOS app.
The company that makes this software just got acquired by another IT software company called Solarwinds, but apparently Solarwinds is planning to do things over there a little differently: the Mac and Linux version download links have been removed from the website. Apple übernimmt Sicherheits-Spezialisten AuthenTec

MacTech and Southern Stars launching a satellite into space

IBM's Think app brings history of innovation to iPad and Android tablets
IBM first tried to make people "Think" using a pop-up art installation in New York, but now it's switched to something rather more traditional: a tablet app that is available free on iOS and Android. Mountain Lion already exceeding 3 percent of Mac traffic
OS X Mountain Lion already represents over 3 percent of Mac traffic on the web, according to online ad network Chitika. The OS was launched early on Wednesday, but achieved the 3 percent figure within a span of about 48 hours. Chitika comments that based on Apple's June statement claiming about 66 million Mac users, this implies that at least that 2.11 million Mac owners have downloaded the new OS so far.

Instagram update disables "Find Twitter Friends" feature
A new version of Instagram (free) just arrived this morning, along with the news that the photoblogging tool now has 80 million users. But there's something missing in the update. If you've ever used the "Twitter Friends" feature, you'll be dismayed to find that it's no longer available.
As you can see in the screenshot from Instagram at right, Twitter is no longer allowing its users to find friends via the Twitter API. You can still tweet your photos; you just can't tap the "Twitter Friends" button to automatically follow your Twitter friends who also use Instagram.

Apple, Samsung bickering over where to sit in court
The bickering between Samsung and Apple just won't stop. The latest report from AllThingsD suggests Samsung is even arguing over where it will sit and what the two companies will be called during the trial. Apple says Google warned Samsung about copying Apple's work
The big trial between Apple and Samsung is slated to begin next week in the US and the two companies are filing briefs in advance to prepare for the jury part of the trial. One juicy tidbit pulled out of Apple's brief by AllThingsD reveals that Samsung was warned by Google and others that its early Galaxy devices were too similar to Apple's products.
According to the brief, Google told Samsung that its prototype Galaxy Tab (P1) and Tab 10.1 (P3) were "too similar" to the iPad and ordered Samsung to make its products a "distinguishable design vis-à-vis the iPad for the P3." TweetDeck updates web-based client with sleeker profiles, enhanced mentions and hashtags
Now that yesterday's sudden Twitter outage is behind us, it's now time to focus on the blue bird's own, and very popular client, TweetDeck. Voice Update 2.0.0 upgrades Mountain Lion system voices
Apple is now distributing v2.0.0 updates for some of the optional voices in OS X, notes AppleInsider. If not already loaded, the voices can be installed by clicking "Customize" in OS X Mountain Lion's upgraded Dictation & Speech panel. Apple mistakenly issues OS X Server codes to users entitled to Mountain Lion
Apple may have had some trouble with its Mountain Lion redemption codes, which provide a free Mountain Lion upgrade to new Mac owners who purchased a system between June 11 through July 25 via the OS X Up To Date program.

News: Best Buy now offering iPhone 4 for $49.99
Best Buy is now offering the iPhone 4 on-contract for $49.99. As noted by 9to5Mac, the pricing is good on black or white 8GB models from AT&T, Verizon, or Sprint. All three require a two-year service plan. Apple ready to buy fingerprint sensor maker AuthenTec
Reuters reports today that Apple is purchasing chipmaker AuthenTec in a deal worth about US$356 million.
AuthenTec makes fingerprint sensor chips that are used in computers made by Lenovo, Fujitsu, and Dell, and also makes security software and chips for mobile phones that are licensed to companies like Samsung. The company also developed a downloadable digital rights management solution that is used on the iPhone and iPad to authenticate HBO GO.

Chinesischer Mikrobot mimt den Wasserläufer (Video)

Ein Team chinesischer Wissenschaftler hat sich den Wasserläufer als Vorbild für ihren , klar, über das Wasser laufenden Mikrobot genommen. Mit einem Gewicht von lediglich 11 Gramm kann er genauso flink übers Wasser hüpfen wie sein natürliches Vorbild, seine Sprünge gehen 14 Zentimeter hoch und immerhin 35 Zentimeter weit. Seine Füsse sind mit einem stark wasserabweisenden Nickel-Schaum beschichtet, der die Aufprallenergie auffängt und so verhindert, dass der kleine Bot untergeht. Apple kauft Authentec für 356 Mio. US-Dollar
Nachdem Apple zuletzt einen Vortrag auf der Black-Hat-Sicherheitskonferenz hielt und damit das Thema auch öffentlich in Angriff genommen hat, wurde nun die Übernahme von Authentec bekanntgegeben. Apple awarded delay on posting about Samsung tablet
Apple successfully argued in a London court that the requirement to post a message on its UK website that says Samsung did not copy the iPad will cause the Cupertino company "irreparable and disproportionate harm." According to a report in Bloomberg, Judge David Kitchin agreed with Apple and said in his ruling that "It would not be right to condemn Apple to such a fate before it has had a chance to argue its case."

On-contract iPhone 4 drops to $50 at Best Buy
Best Buy has dropped the price of the iPhone 4 at its US online store to $50 with a two-year contract. The change applies to models for all three major iPhone carriers, namely AT&T, Verizon, and Sprint. Marco Arment, the creator of Instapaper, weighed in with his thoughts on the future of the Mac App Store. He argued that, unless Apple changes some of its rigid policies, the Mac App Store is doomed. Apple has signed a deal to buy a Florida-based company, AuthenTec, at a price of $8 per share or about $356 million, Reuters says. That's a premium of 58 percent over AuthenTec's Thursday closing value. Mountain Lion 101: Finder encryption with FileVault 2
File encryption isn't one of the sexiest new features in OS X Mountain Lion. Notifications or Game Center probably take that title, but the new FileVault 2 can be very useful, especially for Mac users with sensitive information on their hard drives. Apple has updated its FileVault software to offer fast and easy encryption wherever your Finder goes.
To encrypt your disk completely, head into System Preferences under Security & Privacy and choose the FileVault menu. You will need to turn on FileVault there. You'll also need to make sure Recovery HD is installed on your hard drive. It should have been when you first installed Mountain Lion, but it may not have if something went wrong. Then you'll

It turns out the prototype iPad we saw last week was just the tip of the iceberg in the Apple versus Samsung "patent trial of the century." DIY: 3D-Printer druckt die ersten funktionierenden Schusswaffen aus

Keine gute Nachricht, aber vorhersehbar: inzwischen wurden die ersten funktionierenden Schusswaffen mit einem 3D-Drucker gemacht. Amateur-Waffenschmied "HaveBlue" hat eine funktionstüchtige AR-15 (M16) mit frei runterladbaren CNC-Plänen ausgedruckt, die seiner Aussage zufolge mit ein paar kleineren Abstrichen auch funktioniert wie eine echte. Außerdem hat er dann noch versucht, sein Design bei MakerBot´s Thingiverse unterzubringen, die aber glücklicherweise in diesem Zusammenhang das Teilen von Waffendesigns untersagt haben.

Sure the financials announced this week weren't as exceptional as some we've seen from the company, but Apple's still clearly in a buying mood. The company's apparently doing a little security shopping, picking up AuthenTec for $356 million, according to the mobile and network security firm. Z-1: NASA baut nach 20 Jahren einen neuen Raumanzug

Der letzte Raumanzug den die NASA in Betrieb hat, ist eine Entwicklung aus dem Jahr 1992. Unglaublich aber wahr. Das Ding was aussieht wie ein Rucksack und sämtlichen überlebenswichtigen wie Sauerstoff usw. trägt ist beim jetzigen Raumanzug sogar seit fast 40 Jahren nicht mehr grundlegend überarbeitet worden. Jetzt wird mit dem Z-1 ein neuer Raumanzug entwickelt und der hat ein paar eigenwillige Eigenschaften. Man steigt von Hinten in ihn ein wie durch eine Tür und so lässt sich der Raumanzug direkt ohne Extra-Schleuse an ein Raumschiff andocken und man verliert weniger Luft. Obendrein soll er weitaus beweglicher sein und obwohl er fluffig aussieht wohl auch stabiler

Gestern Abend bei Samsung: Die Audio Docks
Gestern Abend war es mal wieder soweit: Samsung organisierte anlässlich einer neuen Produktreihe eine schicke Veranstaltung, bei der ein paar ausgewählte Gäste vor Ort waren, zu denen auch wir uns zählen durften. Vorgestellt wurden dabei Samsung neue Audio Docks.
Der Eintritt in das nhow Hotel ist schon irgendwie beeindruckend, wenn auch Geschmackssache. Direkt an der Spree, unweit des MTV-Gebäudes gelegen, prangt der quadratische Gebäude. Beworben wird das nhow als das Music and Lifestyle Hotel Berlin. Für mich insgesamt etwas zu modern, aber wie gesagt, das ist Geschmackssache. Passend für die Präsentation war das Hotel aber allemal, denn vorgestellt wurden die ersten Audio Docks von Samsung.

Security experts hack payment terminals to steal credit card info, play games
If a payment terminal could be forced into servitude as a crude handheld gaming device, what else could it be made to do? Researchers at the Black Hat conference showed just what mischief a commonly used UK PoS terminal could get up to when they inserted a chip-and-pin card crafted with malicious code. That enabled them to install a racing game and play it, using the machine's pin pad and screen. Court docs show Apple took design inspiration from Sony
A Samsung filing has revealed what had been a highly confidential iPhone prototype that bears a Sony logo, according to The Verge. In one instance, the same design also carries a 'Jony' logo variant that appears to be a hat tip to Apple design chief Jony Ive. Google Search für Handys jetzt mit Handschrifterkennung
Google.com hat jetzt in der Suche auf Handys eine Handschrifterkennung. Man muss sie allerdings unter google.com/preferences anschalten, damit man in den etwas zweifelhaften Genuss kommt. Wir müssen zugeben, nach ersten kurzen Tests (iPhone) ist die Handschrifterkennung zwar recht problemlos und gut, aber mit der Tastatur sind wir irgendwie doch schneller. “Cashcow” iPhone: Deutlich höhere Gewinnmarge als die des iPad
Mit einem iPhone verdient Apple deutlich mehr als mit einem iPad. Was angesichts des Preises und der Tatsache, dass die Hardware nicht unähnlich ist, ohnehin schon klar war, bestätigen jetzt Gerichtsdokumente aus dem Patentstreit mit Samsung. Aus ihnen geht auch hervor, wie groß der Unterschied ist.
Vor Gericht erklärte Apple, dass die Gewinnmarge beim iPhone im Zeitraum April 2010 bis März 2012 zwischen 49 und 58 Prozent lag. Beim iPad lag sie im Zeitraum Oktober 2010 bis März 2012 wiederum zwischen 23 und 32 Prozent. Zeitweise dürfte die iPhone-Gewinnmarge also mehr als doppelt so hoch gewesen sein wie die beim iPad.
Über jedes verkaufte iPhone dürfte sich Apple also besonders freuen. Das ist vor allem deswegen bemerkenswert, weil sich die Konkurrenz auf dem Markt für Mobiltelefon

Haszbro Lazer Tag (Video)
Unsere amerikanischen Kollegen hab ein paar von Hasbros Lazer Tag Knarren bekommen in die man ein iPhone steckt, um dann gegeneinander loszuballern. Wie man im Video nach dem Break sehen kann, haben sie sichtlich Spass, auch wenn es nach aussen hin etwas unkontrolliert aussieht. Das ganze läuft über eine App auf dem iPhone, und man kann auch einen - eher langweiligen - Single-User-Mode nutzen um Augmented Reality Gegener abzuschiessen. Genug der Einleitung, ab ins Video. Obwohl es in den USA jetzt auf dem Markt ist, ist die App übrigens merkwürdigerweise noch Beta.

Samsung Quartalsergebnisse: Mit Galaxy zum 4,8 Milliarden Gewinn

Für kaum jemand sehen die Quartalsergebnisse so gut aus wie für Samsung. 4,8 Millarden Euro Gewinn, 79 Prozent Steigerung gegenüber dem Vorjahr, 15% mehr als jedes andere Quartal. Dabei steigerten sich die Umsätze "nur" um 21% auf 34 Milliarden Euro. Man schätzt sie haben im Quartal ca. 52 Millionen Smartphones verkauft, was ca. doppelt so viel wie Apple ist. Insgesamt macht das Smartphone-Geschäft bei Samsung mittlerweile über 60% des Gewinns aus. Der Rest des Unternehmens läuft allerdings nicht so rosig. Es ist soweit. Der Börsenflop schlechthin, Facebook, zeigt seine ersten Quartalsergebnisse. Die sind weniger enttäuschend. Die Einnahmen haben sich im zweiten Quartal um 32 Prozent (gegenüber dem Vorjahr) gesteigert und liegen jetzt bei 1,18 Milliarden Dollar, was besser ist als erwartet wurde. Die monatlich aktiven User liegen jetzt bei 955 Millionen und damit auch 29 Prozent höher als letztes Jahr. 186 in den USA und Canada, 246 in Europa, 255 in Asien und die restlichen 268 verteilen sich auf den Rest der Welt. 543 Millionen nutzen Facebook mittlerweile täglich (eine 32% Steigerung) und mobile Nutzer wachsen noch stärker: 543 Millionen (67% Steigerung).

Die Apple iPhone und iPad Prototypen aus dem Patentrechtsstreit mit Sony
So sehr diese Patentrechtsklagen zwischen Sony & Apple (alle anderen nerven ähnlich) uns mittlerweile fast wahnsinnig machen, sie ist schon manchmal einfach eine gute Quelle, um hinter die Kulissen zu blicken. Beim Verfahren in San Jose sind jetzt Dokumente aufgetaucht in denen man eine klare Anlehnung von Apple an Sonys Designs sieht, alberner Weise auch mit dem Schriftzug "Jony", vermutlich für Jony Ive. Obendrein gab es auch ein längliches N90 Prototyp iPhone zu sehen, das genug Platz für ein Keypad gehabt hätte. Prototypen des iPad mit einem eingebauten Stand gibt es auch, aber seht selbst in den ausgiebigen Gallerien.

Following the release of OS X 10.8 Mountain Lion, Paragon Software Group has announced the release of NTFS for Mac OS X 10, a standalone application for dual-boot users designed to ease data manipulation and transfer between OS X and Windows. The application provides the latest NTFS read and write support for Windows drives mounted in OS X, and achieves the speed of native HFS+ drivers. Version 10 is available for free to all version 9.5 users. Older version owners or new purchasers can purchase the software from the Paragon website for $20.

North Korean media reports North Koreans love North Korean tablet
Remember those futuristic PCs we reported North Korea was producing last year? Well now the Democratic People's Republic has unveiled a seven-inch flagship tablet called the Achim (Morning). Understandably, we don't know what's inside this 0.66-pound (300g) device with a five-hour battery life, but it's apparently very popular with local students. Motorola Xoom WiFi's Jelly Bean upgrade arriving for regular users
It looks like that test period was pretty short, as many Motorola Xoom WiFi owners who aren't in the select test group are reporting receiving OTA updates to Android 4.1.1 on their tablets. That makes the Xoom the first 10-inch tablet to see Jelly Bean, and the first around these parts officially rocking it without Nexus in the nametag. OWC shows Mercury Helios PCIe Thunderbolt chassis
OWC has just outed a PCIe Thunderbolt expansion chassis for adding half-length PCIe 2.0 adapter cards with the Mac mini, iMac, MacBook Air, MacBook Pro, and other Thunderbolt-equipped but PCIe-less computers. The professional PCIe cards allow for video capture and/or editing, media transcoding, audio processing and data storage. The Helios chassis can transfer data at up to 10Gbps and are compatible with AHCI-compliant cards.

Apple loses bid to move Kodak hearing to district court
Manhattan District Court Judge George Daniels has rejected Apple's bid to have its patent dispute with Kodak moved out of bankruptcy court and into district court. The move would have complicated Kodak's plan to sell its potentially lucrative patent portfolio in a sealed-bid process later this year. Kodak is attempting to auction off some 700 digital-capture patents, which have generated more than $3 billion in revenues since the turn of the century.

MetroPCS 2012 Q2 sees profits skyrocket to $149 million despite losing nearly 200,000 subscribers
MetroPCS has announced that it pulled in $1.3 billion in the second quarter of the year, only slightly more than it managed in the first. It made a profit of $149 million, well up from the $21 million it pulled in between January and March, despite shedding around 200,000 subscribers in the process. Microsoft admits Surface might ruffle OEM feathers, vindicates Acer in annual report

WIth any new OS revision, the community's general tendency seems to be "upgrade first, ask questions later." Samsung GT-S3752 Duos gets snapped with dedicated ChatON button by Mr. Blurrycam
If SammyHub's blurrycam tipster is to believed, Samsung will soon be swelling its Duos line of dual-sim handsets with the (purported) GT-S732 you see before you. Presumably, the feature phone will sit at the floor of any pricing table since it's packing a meager 2-megapixel camera, 2.4-inch display and a 1,000mAh battery. Notably the handset includes a WiFi radio, which puts us in mind of a messaging-centric handset -- which explains the presence of a dedicated ChatON button beneath the screen.

Sprint iPhone sales hold steady, AT&T and Verizon decline
Sprint has announced that it sold 1.5 million iPhones in the last quarter. That means the company is holding fairly steady for iPhone sales, having sold about the same number in the previous quarter. 40 percent of last quarter's sales were to new Sprint subscribers, so the iPhone is bringing in new money to the company.
Verizon and AT&T weren't quite so lucky -- Verizon saw sales of its iPhone drop from 3.2 million to 2.7 million, and AT&T saw a drop from 5.5 million to 3.7 million. When you consider those numbers, Sprint is doing quite well indeed.

Court docs confirm 59% iPhone margins, 32% iPad margins
According to recently unsealed documents from this coming Monday's Apple-versus-Samsung trial, the Cupertino-based company earned gross margins of 49 to 58 percent on US iPhone sales between April 2010 and the end of March 2012. The iPad had much lower margin between October 2010 and the end of March 2012, seeing profits between 23 and 32 percent. Apple has declined to comment on the court filing.

Universal has finally revealed a release date for Steven Spielberg's classic E.T.: The Extra-Terrestrial on Blu-ray, which will hit shelves October 9th.
