Motorola has quietly tried to fend off a countersuit from Apple by filing for a declaratory judgment against the iPhone maker. The Droid X creator wanted a Delaware court to find the patents in Apple's lawsuits against HTC declared invalid as it believed not just that Motorola's phones didn't infringe but also that Apple was targeting Android as a whole and would likely sue Motorola next. The filing revealed that Motorola had been discussing a licensing deal but that talks had broken down, prompting Motorola's own suit as a preemptive strike.
