French Anti-monopoly Council Kills Apple-Orange Exclusive Partnership in France

The "conseil de la concurrence" (anti-monopoly council) just released its decision regarding the appeal made by one of the 3 main French carriers, Bouygues, regarding the exclusive partnership between Apple and Orange. Following the decision of this Council, Apple HAS TO sell the iPhone to any French carriers that would like to sell this device as a single or bundled product, and CAN NOT refuse to do so. This is a victory for the two main French carriers competing with Orange on this subject for over a year. Orange can appeal, however the decision released by the Council is conservative, in other words, it has to be applied while waiting for the final legal decision of the action. The council determined that there were some serious concerns about a monopoly situation, and the in-depth investigation will require more time to finalize the legal aspect, the iPhone has to be made available in France by Apple to ALL carriers.
